Welcome to Price Book Club ("we," "our," or "us"). By creating an account, using our services,
or accessing the website/app, you ("user," "member," or "you") agree to these Terms and Conditions.
Please read them carefully before registering or using our services.
1. Eligibility
- You must be at least 18 years old or have the consent of a parent/guardian to use this service.
- By using this service, you confirm that all information you provide is accurate and complete.
2. Membership Types
Free Membership
Users may create Public Price Books. Public books can be shared in book clubs.
Data in public books may be used, aggregated, sold, or distributed by Price Book Club
without compensation to the user.
Pro Membership
Users may create Private Price Books. Private books cannot be shared in book clubs
but may be listed for sale on our marketplace.
Sales of private books:
The seller (book owner) receives the full listed price, and Price Book Club charges a commission to the buyer.
Example: If a book is listed at N$100, the buyer pays N$120. The seller receives N$100, and Price Book Club keeps N$20.
3. Ownership of Data
- All books (public or private) and data captured in them remain the property of Price Book Club.
- Users retain ownership of the content they create but grant Price Book Club a perpetual, irrevocable, royalty-free license to use, display, distribute, and sell such data in accordance with these Terms.
- For Private Price Books, Price Book Club may sell or distribute such data only with proceeds remitted to the book owner, after deducting the agreed commission.
4. Data Access & Termination
- Users may request a data export (data dump) of their books (public and/or private), but only upon closing their account.
- Once a data export request is completed, the associated account and email address will be permanently deactivated and cannot be re-registered.
5. Prohibited Uses
You agree not to:
- Scrape, mine, or extract data from the website using bots, crawlers, or similar tools.
- Sell, distribute, or republish any Price Book Club data outside the platform without written consent.
- Circumvent technical restrictions, security features, or copy-protection mechanisms.
- Use the platform for illegal, fraudulent, or misleading activities.
Warning:
Violation of these terms may result in immediate suspension or termination of your account.
Any pending earnings may be withheld, and we reserve the right to pursue legal remedies,
including recovery of damages.
6. Payment & Fees
- Payments for Pro Membership and marketplace transactions are processed through secure third-party providers.
- Price Book Club is not responsible for delays, errors, or losses caused by third-party payment processors.
- Fees and commission rates are subject to change with reasonable notice to users.
7. Liability Disclaimer
Price Book Club provides its services "as is" and "as available."
We do not guarantee accuracy, reliability, availability, or fitness for a particular purpose.
We do not accept liability for any damages, losses, or claims arising from:
- Use of the website/app.
- Errors or omissions in pricing data.
- Financial, personal, or business decisions made using the platform.
- Data loss, downtime, or security breaches.
Important:
Users are solely responsible for their own decisions and outcomes while using the platform.
8. Privacy & Data Protection
- We comply with applicable data protection laws in Namibia and the Southern African Development Community (SADC), including principles from South Africa's Protection of Personal Information Act (POPIA) and the EU's GDPR where relevant.
- Personal information is collected and used only for account management, security, payment processing, and service improvements.
- Users may request deletion of their personal data upon account closure, subject to retention obligations required by law.

9. Intellectual Property
- The platform, design, logos, software, and branding remain the intellectual property of Price Book Club.
- Unauthorized use, reproduction, or distribution of the platform or its content is strictly prohibited.
10. Indemnity
You agree to indemnify and hold harmless Price Book Club, its owners, staff, and partners from any claims, damages, or expenses (including legal fees) arising from:
- Your use of the platform.
- Your breach of these Terms.
- Your violation of any laws or third-party rights.
11. Changes to Terms
- We may update these Terms from time to time.
- Continued use of the platform after changes are published constitutes your acceptance of the revised Terms.
12. Governing Law
- These Terms are governed by the laws of Namibia, without regard to conflicts of law principles.
- Any disputes will be resolved in the courts of Namibia.
